General Terms and Conditions

Somewhere Centre Lda and about our services and activities. This site is the property of Somewhere Centre Lda located at Rua Pôr do Sol nº22 Pocariça, 2405-029 Maceira Lra, with 517917289.

APPLICATION
1. These General Terms and Conditions apply to all visitors to the Somewhere Center website, www.somewherecenter.com (hereinafter referred to as the ‘Site’) and to any other commercial transaction carried out through the Site's online shop.
  Browsing the site and purchasing any product through it implies acceptance of these General Terms and Conditions of Contract and Use by the User and the Customer.
  Before ordering any product on our Site please read these Terms carefully and print or save a copy for future reference.
  Somewhere Center reserves the right to revise and amend the General Terms and Conditions at any time without prior notice, provided that they comply with the provisions of Decree-Law 24/2014, of 17-02, as amended by Law 47/2014, of 28-07.
CONTENT INFORMATION
Article 4 of Decree-Law 24/2014, of 17 February, as amended by Law 47/2014, of 28 July.
The reproduction, transfer, distribution or storage of the contents of the www.somewherecenter.com website without prior written authorisation granted by Somewhere Center is prohibited for purposes other than strictly personal use.
Every effort has been made to ensure that the information presented is free of typographical errors. However, should such errors occur, Somewhere Center will correct them as soon as possible. Obvious errors such as pricing, calculation or typographical errors in offers, promotions, folders, brochures, catalogues, order confirmations, invoices and other written statements by Somewhere Center are not binding.
The product photographs shown on the website are for illustrative purposes only. As such, Somewhere Center recommends that the Customer consult the detailed description of the product in order to obtain complete information about its characteristics, as well as request more precise information if they so wish.
OFFER AND AGREEMENT
1. The offers and promotions on the Site do not imply any obligation. By completing your order on the Site, you are making a binding offer to purchase the product(s). All orders are subject to acceptance by Somewhere Center and the agreement between you and Somewhere Center will only be formalised when Somewhere Center commences performance of the Contract. If the products ordered are no longer available or are out of stock, Somewhere Center will inform you and reject the order. If possible, we may offer other products of a similar nature and quality instead.
2. The prices shown are in euros. The availability of the products shown on the Site is limited to the stock available at any given time.
DELIVERY COSTS
Delivery charges will apply to the Products ordered. There is no possibility of refusing delivery or the costs associated with it. The delivery price is indicated on the Website.
PRICES, PAYMENT
Article 4 of Decree-Law 24/2014, of 17 February, as amended by Law 47/2014, of 28 July.
1. The applicable prices are the prices of the products displayed on the Site. All products contain an indication of the price with and without VAT in Euros. Delivery costs and all other additional costs are indicated separately on the Site.
2. Payments can be made by:
  a) by Bank Transfer
  b) by PayPal
  c) by ATM references
3. In certain cases Somewhere Centre may restrict payment to Bank Transfer only.
4. Bank transfer:
  After placing your order, you will receive a confirmation email with Somewhere Centre's bank details so that you can proceed with the transfer. After finalising the transfer, please send an email to somewherecenter@gmail.com with proof or confirmation, mentioning the order number. The bank details will be indicated when finalising the order on the website.
  Your order will be processed as soon as we receive payment, if you choose bank transfer.
5. PayPal
  Once the order has been finalised, the payment procedure begins. If you choose this payment method, you will be redirected to the PayPal page where you can confirm your purchase.
6. Multibanco reference
  Once the order has been completed and the payment procedure has begun, and the customer has chosen this payment method, the references needed to make the payment will be made available to the customer.
7. The order will be processed as soon as we receive confirmation of payment, in either form.
DISCOUNTS
1. The period of validity of the promotions shown can be found on all the product sheets by clicking on ‘info promotion’ next to the promotion.
2. Promotional discounts will be given on the condition that the order is finalised by the User through the checkout and paid for by the end of the advertised period.
3. Saving a product in the ‘shopping basket’ does not guarantee the price or the discount if you do not comply with the previous point.
ENTREGA / RECOLHA
1. Somewhere Center will endeavour to inform you of the expected delivery dates as soon as the order has been completed, but the maximum delivery time will never be more than 20 days.
2. The delivery period begins on the day the contract is concluded, as provided for in article 3.1, unless the parties expressly agree otherwise
3. If any item is damaged or missing from your order, please contact 917420102 or somewherecenter@gmail.com within 5 days of delivery. If a product is damaged upon delivery, the carrier must be informed at the time of delivery. The product will be collected within 14 days of the day on which the Customer contacts us, unless otherwise agreed from time to time.
4. The products are delivered to the location specified at the time the order is placed. Ownership of the goods passes to the Customer on full payment of the price and any other amount. The risk of loss or damage to the goods passes to the Customer at the time of delivery.
5. The Products will be delivered (by a carrier) to the address indicated by the Customer. If you choose to place your order in more than one order process, different delivery times may apply.
6. Delivery to Continente
  1. Deliveries are made between 9am and 6.30pm and it is not possible to indicate the exact time of delivery. The day before the order is dispatched, you will receive an e-mail with the invoice and more information about the shipping and delivery conditions. Products will only be delivered personally and cannot be left on driveways, porches or other places outside the house.
7. Island delivery
  1. As a rule, shipments are made by the carrier Somewhere Centre works with. Shipping costs are calculated on a case-by-case basis. When the order is confirmed, the Customer will be informed of the amount.
WARRANTY/CLAIMS
Article 4 of Decree-Law 24/2014, of 17 February, as amended by Law 47/2014, of 28 July.
1. The Customer always has the legal right to a guarantee, for the equipment required by law, for a period of two years from delivery of the product, under the terms and conditions of the law.
2. In the event that you wish to make a claim under an additional guarantee provided by Somewhere Center, you must inform Somewhere Center of the defect as soon as possible and, in the last resort, within 2 (two) months after it has been possible to reasonably discover the defect, failing which you will lose the right to make any claim under the guarantee. Claims relating to perishable products must be made within 48 (forty-eight) hours of delivery.
3. Under Somewhere Center's additional warranty on its own brand products, claims can be made for defects in material or workmanship. A valid claim shall give rise to a repair or replacement of the Products free of charge, at Somewhere Centre's discretion. If repair or replacement is not possible or reasonable in view of the costs involved, Somewhere Center is entitled, as a final remedy, to reimburse the costs.
4. After reporting the defect, the Customer must allow Somewhere Center to analyse the Products. The inspection of the defective Product takes place at Somewhere Centre's premises. Transport/return costs shall be borne by Somewhere Center unless the warranty claim is denied, in which case the Customer must pay the transport costs.
5. Any defects in the Products that result from normal wear and tear or any other external cause, such as, but not limited to, damage by transport by the Customer, incorrect use, or if the Customer has made any repairs to the product without Somewhere Center's prior written authorisation, shall not be covered by the warranty, unless such use or repairs are inherent in the use of the Products.
LIABILITY AND COMPENSATION
Article 4 of Decree-Law 24/2014, of 17 February, as amended by Law 47/2014, of 28 July.
1. Somewhere Centre's liability is limited to the extent permitted by law. Somewhere Center shall never be liable for any damages of the Customer if:
  a. Damage results from non-compliance with producer responsibility, unless Somewhere Centre is legally responsible under the law;
  b. The damages are indirect and/or consequential damages.
2. Should damage occur, the Customer is obliged to limit, as far as reasonably possible, any additional or other damage.
RIGHT OF RETURN / CANCELLATION
Articles 4, 10 to 14 and 17 of Decree-Law 24/2014, of 17 February, as amended by Law 47/2014, of 28 July.
1. The Customer has the right to withdraw from the contract within 14 days of the day on which the Customer or a third party on his behalf acquires physical possession of the goods, or of the last goods in the case of several goods ordered in a single order and delivered separately. You can exercise your right of cancellation at: Somewhere Center , Rua Pôr do Sol nº22 Pocariça, 2405-029 Maceira Lra indicating the decision to terminate this contract by unequivocal statement (e.g. letter sent by post, fax or e-mail), to be sent before the deadline referred to in the previous paragraph. You can use the attached model cancellation form.
  
  Effects of the resolution
  
  If the Customer terminates the contract, we will reimburse all payments received, including delivery costs (with the exception of supplementary costs resulting from the choice of a type of shipping other than the cheapest standard shipping method made available by us), without undue delay and, in any case, within 14 days from the day on which we are informed of the decision to terminate that contract. We will proceed with the refund using the same means of payment used in the initial transaction, unless expressly agreed otherwise, within a maximum of 72 hours. In any event, the Customer shall not incur any costs as a result of such reimbursement. We reserve the right to withhold the refund until we have received the returned Products or until proof of despatch of the items has been provided, whichever is the sooner.
  Return of items
  If the Customer chooses to exercise the right of withdrawal, it is the Customer's responsibility to bear the cost of returning the goods.
  Liability and guarantee
  The Customer shall only be liable for depreciation of the articles resulting from handling other than that necessary to verify the nature, characteristics and functioning of the articles.
2. To exercise the right of withdrawal you can use the model withdrawal form attached to these Terms, which you can also find on the Website. Alternatively, you can terminate the contract by issuing an unequivocal statement to Somewhere Centre stating that you wish to terminate the contract.
3. All products containing used consumables (e.g. consumables, if any) may only be exchanged/returned by replacing these consumables. Somewhere Center reserves the right to charge/retain costs for the content of such consumables used by the Customer.
4. Your right of cancellation does not apply: the supply of products made to the consumer's specifications or clearly personalised; the supply of products susceptible to rapid deterioration; the supply of products which are not returnable for reasons of health protection or hygiene and from which the seal has been removed after delivery; the supply of sealed audio or video recordings or sealed computer programmes from which the seal has been removed after delivery; the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer's prior express consent and acknowledgement that he thereby loses his right of withdrawal; unsealed cartridges and other consumables (e.g. consumables if any), which are not sealed: consumables if any), which are not described in clause 10. 3, unless they are defective.
